De afgelopen maanden werd het FAGG herhaaldelijk gecontacteerd over overschrijdingen van donorquota. Deze overschrijdingen werden vastgesteld zowel bij bepaalde fertiliteitscentra als op nationaal niveau. Ze betreffen zowel centrum-eigen donoren als buitenlandse donoren, al dan niet met een Rapid Alert.
In lijn met het herstelplan wil het FAGG daarom duidelijke, transparante en contextuele toelichtingen verstrekken, om de interpretatie van de informatie in de onderstaande tabellen te vergemakkelijken.
Het is belangrijk te benadrukken dat de voorgestelde gegevens zijn gebaseerd op de informatie die momenteel beschikbaar is en die door de fertiliteitscentra werd overgemaakt in het kader van inspecties en biovigilantiemeldingen. Deze cijfers kunnen wijzigen naarmate nieuwe informatie beschikbaar komt. De cijfers worden maandelijks geactualiseerd.
In deze context kan het FAGG de volledigheid van de gepubliceerde gegevens niet garanderen.
Daarnaast zet het FAGG de actualisering van Fertidata actief verder, met als doel een vollediger en nauwkeuriger overzicht te verkrijgen van mogelijke quotaoverschrijdingen.

De onderstaande tabel geeft een overzicht van de Europese ‘Rapid Alerts’ waarbij de Belgische wettelijke limiet van 6 vrouwen, die elk minstens één kind hebben gekregen van dezelfde donor, werd overschreden (vanaf 2022). Aantal vrouwen dat ten minste één kind heeft gekregen (behandeling in België).
De gegevens in deze tabel zijn opgesteld op basis van de informatie die door de fertiliteitscentra wordt meegedeeld. Dat overzicht kan nog worden aangevuld naarmate bijkomende informatie beschikbaar wordt. De gepubliceerde data geven dus de huidige stand van zaken weer en kunnen onvolledig zijn.
Het aantal zwangerschappen in deze tabel stemt niet noodzakelijk overeen met bevestigde zwangerschappen of geboortes. Er kan een verschil bestaan tussen het aantal zwangerschappen, het aantal kinderen en de gegevens die beschikbaar zijn op het moment van de melding (bv. afgebroken zwangerschappen, lopende zwangerschappen, nieuwe zwangerschappen).
Het is belangrijk op te merken dat het blokkeren van een donor het gebruik van zijn gameten niet verhindert bij wensouders, met het oog op het verwekken van een broer of zus van een reeds geboren donorkind, op basis van een donatie van deze donor. Ook al zal het aantal gezinnen dus niet verder toenemen, kan het aantal kinderen binnen éénzelfde gezin nog evolueren.
Een rapid alert is een melding die wordt uitgegeven door een bevoegde autoriteit van een lidstaat van de Europese Unie om de andere betrokken lidstaten te informeren in geval van een gezondheidsrisico bij het gebruik van weefsels en cellen. Wanneer een spermadonor het onderwerp is van een rapid alert, wordt deze donor permanent geblokkeerd en mag zijn sperma niet langer worden gebruikt voor de behandeling van een nieuwe vrouw.

2. Globaal overzicht van quotaoverschrijdingen
De onderstaande tabel geeft een overzicht van alle quotaoverschrijdingen waarvan het agentschap op dit moment kennis heeft. De hierboven vermelde Rapid Alerts zijn hierin opgenomen.
Deze situaties zijn onder de aandacht van het agentschap gebracht via verschillende kanalen, met name:
- biovigilantiemeldingen en/of Rapid Alerts;
- in het kader van inspecties;
- naar aanleiding van spontane meldingen door fertiliteitscentra.
De tabel bundelt alle vastgestelde overschrijdingen per donor, ongeacht het aantal betrokken centra.
Wanneer een overschrijding met betrekking tot een donor werd vastgesteld binnen één enkel centrum — bijvoorbeeld wanneer dit centrum dezelfde donor heeft gebruikt voor meer dan zes gezinnen — wordt dit uitdrukkelijk vermeld in de laatste kolom (« quota exceedance within a centre »).
Wanneer deze kolom leeg is, betekent dit dat de overschrijding is gespreid over verschillende centra, zonder dat één centrum afzonderlijk de grens van zes gezinnen heeft overschreden.
Dit globale overzicht draagt bij tot meer transparantie, een coherente opvolging van de geïdentificeerde situaties en een globale evaluatie van de naleving van de geldende quota.
